Terms of Use

1. Acceptance of these Terms

By accessing or using Pulse5 — whether as a signed-in user or anonymously — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use Pulse5.

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Pulse5. If you use Pulse5 on behalf of a company or other entity, you confirm you have authority to bind that entity to these Terms.

2. What Pulse5 does

You describe a website in plain language. Pulse5 uses a third-party AI model to generate a plan, searches for candidate photos, and writes a React + TypeScript + Tailwind CSS project that you can preview, refine by chatting, and download as a runnable project.

Pulse5 is a tool that assists you in producing a website — it does not review, edit, fact-check, or legally clear the content it generates on your behalf. You are responsible for reviewing everything Pulse5 produces before you publish, deploy, or rely on it.

3. Accounts

You can use parts of Pulse5 anonymously, with projects kept only for your current session. Creating an account (by email and password, or by continuing with Google) lets you save projects to your workspace and return to them later.

You're responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us right away if you suspect unauthorized use of your account.

4. Your prompts and content

You keep ownership of the prompts, instructions, and any text or media you upload to Pulse5 ("Your Content"). By submitting Your Content, you grant Pulse5 a worldwide, non-exclusive, royalty-free license to use, process, store, and transmit it — including to a third-party AI model and image-search provider — solely to operate and provide the service to you.

Do not submit content you don't have the right to share, or content that is illegal, infringing, or violates someone else's rights.

5. AI-generated websites — ownership and limits

Subject to these Terms and to Section 6 below, we assign to you our rights (if any) in the website code, layout, and copy that Pulse5 generates specifically for your project, so that you're free to use, modify, and deploy it.

Because this output is produced by an AI model, it comes with real limitations you should plan around:

• The AI can make mistakes: broken logic, inaccurate copy, or content that looks plausible but is wrong.
• Generated code, names, or copy may unintentionally resemble existing third-party work. We do not run originality or trademark checks on AI output.
• Pulse5 makes no warranty that generated content is accurate, complete, non-infringing, or fit for any particular purpose.

Always review generated code and copy — including for accuracy, tone, trademarks, and legal claims — before you publish it or present it to your own users or customers.

6. Images found by Pulse5 — copyright and licensing

Pulse5 disclaims all responsibility for the copyright or licensing status of any image it surfaces, and you agree to indemnify us as described in Section 13 for claims arising from images you chose to keep and publish without clearing them.

7. Acceptable use

You agree not to use Pulse5 to:

• Build sites that are illegal, fraudulent, or that facilitate illegal activity;
• Impersonate a person, brand, or organization, or create sites designed to deceive visitors (phishing, scams, fake storefronts);
• Generate or distribute malware, or content that harasses, defames, or exploits any person;
• Infringe someone else's intellectual property, privacy, or other legal rights;
• Probe, scan, or attempt to disrupt Pulse5's infrastructure, or circumvent rate limits and access controls;
• Use automated means to scrape or bulk-generate content in a way that abuses the service.

We may suspend or terminate accounts that violate this section, with or without notice.

8. Fees, plans, and billing

8.1 Available plans

Pulse5 offers a free tier and paid subscription plans (currently Pro at $15/month and Scale at $39/month). Paid plans are billed monthly in advance. All prices are in US dollars and exclude any applicable taxes.

8.2 Message credits

Each plan includes a monthly allocation of message credits ("messages"). Free plan users receive 10 messages per day; paid plans receive a monthly credit that does not carry over to the following month unless otherwise stated. Credits are consumed when you send a prompt that triggers an AI generation. We reserve the right to adjust credit allocations with 30 days' notice.

8.3 Payment and renewal

Paid subscriptions renew automatically at the end of each billing period. You authorise us (or our payment processor) to charge your payment method on file at the then-current rate. If a payment fails, we will notify you and your account may be downgraded to the free tier until payment is resolved.

8.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to your paid features until then. We do not provide pro-rated refunds for partial months unless required by law.

8.5 Refunds

Except where required by applicable consumer protection law (including EU/UK statutory rights), all payments are non-refundable. If you believe you were charged in error, contact us at support@pulse5.site within 30 days of the charge.

8.6 Price changes

We may change subscription prices. If we raise the price of your active plan, we will give you at least 30 days' notice by email before the new price takes effect. Continuing to use the service after the effective date constitutes acceptance of the new price.

8.7 Taxes

You are responsible for any sales, VAT, GST, or similar taxes applicable in your jurisdiction. Where we are required to collect taxes, they will be added to your invoice.

9. Pulse5's intellectual property

Pulse5's brand, logo, website, underlying software, and the builder itself (as distinct from the individual site you generate) are owned by us or our licensors and are protected by intellectual property laws. These Terms don't grant you any rights to Pulse5's own trademarks or branding.

10. Third-party services we rely on

Pulse5 is built on top of third-party infrastructure, including an AI model provider that generates plans and code from your prompts, an image-search provider, an authentication and database provider, and hosting infrastructure. Your prompts and, where applicable, your account information are shared with these providers strictly to deliver the service to you.

These providers have their own terms and reliability characteristics. We aren't responsible for outages, errors, or content originating from third-party systems we integrate with, though we work to choose reputable providers and to respond to problems quickly.

If you connect a GitHub account, a Supabase account, or a custom domain, you authorize Pulse5 to access and modify those third-party accounts/services to perform the actions you request (for example, pushing code to a repository, running SQL against a database, or registering a domain). You can disconnect any of these integrations at any time from your project settings; disconnecting stops future access but does not undo actions already taken.

11. Disclaimers

Pulse5 is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Pulse5 will be uninterrupted, error-free, or that AI-generated output will be accurate, complete, or suitable for your purposes.

12. Accessibility

Pulse5 doesn't fully support accessibility yet. Parts of the builder — like the live site preview and the file tree — aren't built for screen readers or full keyboard use, and we don't check whether the websites Pulse5 generates are accessible either.

If you rely on assistive technology, we'd recommend not using Pulse5 for now until this improves. If you run into a problem, let us know at contact@pulse5.site and we'll try to help.

13. Limitation of liability

To the maximum extent permitted by law, Pulse5 and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising from your use of the service — including damages arising from AI-generated content, third-party images, or third-party service outages. Our total liability for any claim relating to Pulse5 will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

When you connect a GitHub or Supabase account, actions you request — pushing code, running SQL, creating or modifying repositories or database tables — are carried out directly against your own third-party account. Pulse5 is not responsible for data loss, overwritten files, broken deployments, or any other consequence of those actions, including mistakes in what you selected to push or run. Review what you're about to push or run before confirming it.

14. Indemnification

You agree to defend, indemnify, and hold Pulse5 harmless from claims, damages, and expenses (including reasonable legal fees) arising from: (a) content you publish using a site built with Pulse5, including unlicensed images you chose not to replace; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

15. Termination

You may stop using Pulse5 and delete your account at any time. We may suspend or terminate your access if we reasonably believe you've violated these Terms, misused the service, or created risk or legal exposure for us or other users. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnification) will continue to apply.

16. Changes to these Terms

We may update these Terms as Pulse5 evolves. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in the product. Continuing to use Pulse5 after changes take effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or your use of Pulse5 will be subject to the exclusive jurisdiction of the competent courts located in Israel, and you consent to personal jurisdiction there.

To the extent permitted by applicable law, any claim must be brought within one year after the cause of action arises, or it is permanently barred.
